Our Guarantee
Peaceful Heritage Nursery Company guarantees you will receive top-quality products and plants, true-to-name and type, disease-free, and vigorous in growth when reasonable and proper care is given. Dormant, leafless plants that fail to show signs of life (by June of the year of shipment) when reasonable and proper care are given (including following the Planting Instructions emailed to each customer) will be replaced for free per the No Signs of Life policy.
If there is any problem or concern with your order upon arrival, you must contact us immediately. We generally will replace for free any plants or shipments damaged during transit by the carrier if we evaluate that the damage is serious. If you think this has occurred, you have 3 days to contact us upon arrival of your order, or we will not be able to replace the shipment. You must follow the Damaged Shipment instructions below. Upon making a purchase with our nursery, you must agree to our Terms as described on this page.

Critical to this exchange is our emphasis on excellent and timely customer service, communication, and follow-through, as well as honest, ethical business practices. Part of achieving this goal is providing clear Terms and Conditions that you, as our customer, must agree to when making a purchase with our nursery.
Replacement Policies
Damaged Shipment
We replace or credit any shipments seriously damaged or lost en route by UPS or USPS. Contact our nursery immediately if this occurs with your shipment and provide at least 3 clear photographs via email.
What do we mean by ‘seriously damaged’? We take great care in safely packaging your order to arrive safely. However, when we ship live plants in boxes, occasionally a plant tip, twig, or branch will snap. This occasional wear and tear during shipment is unavoidable. Our plants are strong and vigorous and rapidly grow back or recover from any wear during shipment. Therefore, minor wear such as a twig or tip snapping in shipment is not considered a truly ‘damaged shipment’ if we determine the wear to be minor and negligible and not a factor to the survival and establishment of the plant.
Your Responsibility as Our Customer
We do our very best to only sell and ship high-quality, living plants directly to you. How they are cared for after shipment is completely beyond our control, and the many variables that may affect their survival are endless. Therefore, our replacement/credit policies apply only to purchased plants that do not show signs of life or sprout leaves by June of the year you receive them or that are damaged during shipment to you by the carrier.
Plants that are otherwise damaged or destroyed by customer delay in unpacking plants or delays in planting them, inclement weather, improper handling, neglect, deer, animals, insects, pets, herbicides, dehydration/overwatering, equipment, string trimmers, etc., cannot be replaced or refunded through our Guarantee.
It is also your responsibility as the customer to inform yourself of exactly what you are purchasing and to know beforehand if it is suitable for your needs, climate zone/region, and to read descriptions carefully to know accurately what you are going to receive. We provide very clear and concise descriptions of species, variety, and approximate plant sizes for every item we sell for this exact purpose of informing you, the customer, of what you are ordering. Plant sizes are approximate and may vary by a few inches occasionally. We deal in living, breathing plants, and these have natural variations in size and height, so all sizes are approximate.
Cuttings, Seeds, and Scion Wood
We do our very best to only sell and ship high-quality, living plant materials directly to you. How they are cared for after shipment is completely beyond our control, and the many variables that may affect their survival are endless. Cuttings, seeds, and scion wood are delicate and extremely perishable and can be challenging to establish.
Therefore, our replacement/credit policies DO NOT apply to scion wood, seeds, or cuttings of any kind, including root cuttings. These items are purchased at the buyer’s risk completely as they require considerable skill and outside inputs to be successful, and your success with these items will vary and is completely out of our control as a nursery. If you believe your shipment of seeds/cuttings/scion wood was delivered in a damaged or compromised state, provide clear photos and email us immediately.
It is also your responsibility as the customer to inform yourself of exactly what you are purchasing. This means reading product listings carefully, determining beforehand if it is suitable for your needs, your climate zone/region, and how best to handle it. We provide comprehensive instructions that should be followed.
Stolen or Missing Shipments
In the age of ‘porch pirates,’ we regret that any order which the carrier tracking shows to have been ‘DELIVERED’ but has gone missing or was stolen is not covered by any replacement policy. That is out of our realm of responsibility as a nursery. Alert UPS and your local law enforcement. You can start a CLAIM with UPS in this case.
Pawpaw Trees
We take pleasure in selling only the best fruiting plants possible at reasonable prices. Pawpaw trees are fragile and adapted only to certain regions. However, many of our customers may plant them in inappropriate locations and regions or fail to give them adequate care and/or protection, which will result in failure. We therefore offer no replacements or credit for failed pawpaw trees for any reason except serious damage during shipment. If upon receiving you feel concerned about your pawpaw trees, contact us immediately.
Pawpaw trees/plant material/seeds/scion wood cannot be returned, and no refunds will be given on already shipped or picked-up orders of these products.
Potted Trees and Plants
Plants and trees shipped to you POTTED and therefore sometimes leafed out (non-dormant) are covered by a 60-day replacement policy from receiving if they fail during that time, with no guarantee extending through the winter or into the next year after purchase. Beyond this 60-day period, no potted plants are covered. No trees or plants are guaranteed against winter kill. If you received a dormant/leafless POTTED tree or plant and that plant never leafs out or shows signs of life, we will replace it for free. Simply contact us immediately, email several clear photographs, and let us know exactly what you ordered and the concern with the plant.
PLEASE NOTE: We do not replace, refund, or warrant under any circumstances any plants killed by pets, deer/wild animals/livestock, machines/string trimmers, herbicides, neglect, dehydration, poor planting site, winter kill, or planting error. That is far beyond the responsibility of us as a nursery and is the purchaser’s/customer’s liability only.
Circumstances Invalidating Replacement Policies
Either of our replacement policies are invalidated by the following circumstances:

If you receive plants or trees from us and do not get them planted in the ground within three (3) days.

Our Replacement Policy is invalidated for any plants or trees planted in pots or containers of any kind.

If you receive potted trees or plants and do not get them planted in the ground within (7) days, or attempt to up-pot them into larger pots, store them potted over the winter, or raise them indoors.

Our Guarantee does not apply to plants shipped outside their recommended USDA hardiness zones given on our website. Example: Trees recommended for USDA Zones 6-9 but shipped to and planted in USDA Zone 4 or 5 are disqualified for replacement or credit.

Our Guarantee does not replace or warrant any plants killed by pets, deer/wild animals/livestock, machines/string trimmers, herbicides, neglect, dehydration, poor planting site, winter kill, storms, temperature variations, weather, or planting error. That is far beyond the responsibility of us as a nursery and is the purchaser’s/customer’s liability only.

Our Guarantee does not apply to international orders. International orders do not have any Guarantee or replacement policy due to the extreme conditions shipments must undergo in transit.

Our replacement/credit policy is invalidated if you provide the incorrect address on your order and do not receive it. We also cannot replace shipments that have been damaged, stolen, or tampered with en route.
All of these above events can lead to plant damage and plant demise, which are far outside of our realm of responsibility as a nursery, and disqualify you from receiving a replacement, credit, or refund. Under no circumstances does our liability as a nursery extend beyond the price of the plants or trees purchased from Peaceful Heritage Nursery LLC.
Refunds
We take pleasure in selling only the best fruiting plants possible at reasonable prices. If there is any problem with your order, please contact us immediately via email. As per our Guarantee, we will provide equal credit for any plants shipped to you in a dormant state that fail to leaf or bud out or show signs of life by June of the year you receive them. Refunds can be requested on any order only if it has not yet shipped and will be refunded in full. Already shipped or picked-up orders will not be refunded.
No refunds will be issued on orders that have already shipped.
No refunds will be given on plants or orders of products purchased in a previous year (e.g., purchased in 2021, asking for a refund in 2022). We will evaluate your concerns and move towards a solution.
Trees/plants/plant material/seeds/scion wood cannot be returned, and no refunds will be given on already shipped or picked-up orders of these products.
Plants that for whatever reason fail after leafing out and showing signs of regular growth are not refundable. Contact us in this situation.
If we are unable as a nursery to replace a plant that qualifies for a replacement, then we will issue the customer a full credit with our nursery.
International Shipments
We perform all due and legal diligence in cooperating with USDA regulations regarding international shipments, including USDA Phytosanitary Certification. However, international shipments of seeds/scion wood/cuttings are done at extra effort, time, and expense to our nursery and are highly risky by nature of the vast distances and multiple inspection agencies. Due to the fragile nature of such live shipments and the high likelihood of complications, NO international shipments are Guaranteed to arrive safely, be accepted by your country’s international shipment inspectors, or arrive in viable condition to your address. ANY AND ALL international shipments out of the USA are made at the buyer’s risk and will under no circumstances be refunded, replaced, or credited for any reason. The buyer assumes all risks and bears all potential for lost, damaged, rejected, or dead shipments.
Important
By making a purchase with our nursery, you are agreeing to our Terms and Conditions. We have aimed to make these as fair and reasonable as possible. Peaceful Heritage Nursery LLC assumes no liability beyond the price of the plants/plant material and trees purchased, for any reason. Thank you for doing business with us!
Shipping Restrictions
We no longer ship orders of live plants to Idaho. Due to state regulations and ongoing challenges with orders shipping to this state, we now only ship books, seeds, cuttings, and other similar items. We apologize for any inconvenience.
Shipping to Utah, Idaho, and Washington may require additional shipping fees. We do not ship any items to Alaska, Puerto Rico, Guam, or Hawai’i.
Privacy Policy
We respect your privacy and never sell or give your information to any third party, including your email address, physical address, or telephone number. We use your contact information only to contact you if we have any questions and to occasionally send out valuable promotional emails and newsletters. You can easily unsubscribe from any of our promotional emails via the opt-out link at the bottom of the email received.
